The Fulton County District Attorney’s Office has moved to dismiss an appeal that challenges District Attorney Fani Willis’ role in prosecuting former President Donald Trump and his co-defendants, accused of scheming to overturn Georgia’s 2020 presidential election results.
The appeal followed a ruling by Fulton County Judge Scott McAfee, who allowed Willis to remain on the case provided special prosecutor Nathan Wade resigned due to their past romantic relationship, which the defense argued created a conflict of interest.
Attorneys for Trump and his co-defendants alleged Willis financially benefited from her relationship with Wade, who she hired to lead the prosecution team. However, prosecutors argued Wednesday that the appeal lacked sufficient evidence, as reported by WSB-TV.
Prosecutors’ court filing, obtained by The Washington Post, stated that the defense’s theory was unsupported by the evidence. “Appellants argued that the case was initiated, and then unnecessarily prolonged, in order for the District Attorney to enrich herself via Wade’s employment,” the filing noted. The trial court found no evidence to support this claim.
Trump attorney Steve Sadow criticized the motion as a “last-ditch effort” to avoid appellate review of Willis’ conduct. He pointed out that Judge McAfee had acknowledged an “odor of mendacity” from the testimony and “reasonable questions” about the truthfulness of Willis and Wade.
Despite McAfee’s ruling that there was no “actual conflict” necessitating Willis’ exit if Wade resigned, Trump’s team argued that Wade’s resignation did not resolve the appearance of impropriety.
Last year, a grand jury indicted Trump and 18 others on charges of conspiring to overturn Georgia’s election results. While four have pleaded guilty, Trump and the remaining defendants have denied wrongdoing.
