A judge rejected the charge surrounding the 2021 fatal shooting on the Rust movie set, and Alec Baldwin has now launched a civil complaint for malicious prosecution and civil rights violation.
According to Knewz.com, the shocking complaint was filed in the Santa Fe state district court, where a judge threw out Baldwin’s involuntary manslaughter allegation for the July murder of cinematographer Halyna Hutchins.
As per the lawsuit, the actor also claims slander and asserts that detectives and prosecutors purposefully manipulated evidence while pursuing the case.
The complaint stated: “Defendants sought at every turn to scapegoat Baldwin for the acts and omissions of others, regardless of the evidence or the law.”
Prosecutors and investigators allegedly singled out the actor for political or professional advantage, according to the lawsuit.
Santa Fe District Attorney Mary Carmack-Altwies and special prosecutor Kari Morrissey are among the defendants in Baldwin’s case.
Three investigators from the county board of commissioners and the Santa Fe County sheriff’s office were also involved.
When a judge in New Mexico rejected the involuntary manslaughter prosecution against Baldwin for a fatal gunshot on the set back in July, Baldwin sobbed in court.
His attorneys asserted that prosecutors and police concealed a set of bullets, which may have been evidence linked to the shooting death.
The concealed bullets, which might have been evidence in connection with Hutchins’ death, were submitted under a different number in a different case, according to Baldwin’s attorney.
The judge decided that Baldwin’s defense team should have been informed of the concealed bullets, despite the prosecution’s contention that they had nothing to do with the Rustshooting case and did not match other ammo discovered on the set.
The judge declared: “The state purposefully and knowingly withheld this information. The court cannot make amends for this injustice.
After a crime-scene technician informed the court that a retired police officer named Troy Teske had turned over live ammunition, which may have been connected to the case, the rounds were discussed during the court hearing.
Prosecutor Kari Morrissey testified at the conclusion of the hearing regarding the rounds and the reasons the defense was not given access to them. She stated that she believed the ammunition had “no evidentiary value.”
Baldwin’s attorneys questioned the errors made by the investigating authorities throughout the investigation.
A live cartridge fired from a prop handgun Baldwin was using on the set of the film in October 2021 killed cinematographer Halyna Hutchins and wounded director Joel Souza.
Baldwin stated that he did not know the revolver was loaded with rounds when he pulled back the hammer but did not squeeze the trigger, causing it to fire.
Baldwin was charged with involuntary manslaughter by the Santa Fe district attorney on January 31, 2023.
He entered a not guilty plea to the accusation.
