On August 15, 2024, Tyler James Esponge, 38, of Canton, was convicted by a Cherokee County jury of severe child abuse charges, including cruelty to children in the first degree, aggravated battery, and battery. The verdict came after a three-day trial in Superior Court before Judge Tony Baker, where the jury took less than an hour to deliberate and reach a decision.
The case against Esponge was brought to light following a disturbing report by a nurse at Wellstar Kennestone Hospital on February 10, 2021. The medical examination revealed that the 3-year-old victim, who is both nonverbal and deaf, suffered from multiple injuries, including a buckle fracture of the right femur, bite marks on various parts of her body, petechiae under her left arm, and extensive bruising. These injuries were attributed to the child being left alone with Esponge while her mother was at work.
Authorities discovered the abuse after the mother sought medical care upon noticing the child’s injuries. Since the child could not communicate due to her condition, forensic evidence played a crucial role in the investigation. Male DNA was found on the bite marks, linking Esponge to the abuse. Further investigation revealed that Esponge had a history of similar offenses, including previous abuse of another child over a decade ago.
The prosecution presented a comprehensive case, including testimony from ten witnesses such as law enforcement officers, medical professionals, forensic experts, and child abuse specialists. A total of 29 exhibits were also introduced to substantiate the claims. The investigation was conducted by the Canton Police Department, with Deputy Chief Assistant District Attorney Rachel Hines of the Special Victims Unit leading the prosecution.
